And I guess the police don't have the right to check your phone to know if it's unlocked or not, as it might hurt privacy.

Doesn't phone networks lock their network to phones?

well here in france phone networks lock your phone for a limited time and they must unlock it for you if you ask them once that time has passed, and unlocking it is not repressed.

You can also buy totally free phones which aren't related to any phone network.
