if the all point is to go legit with this project, then all depends on the permission to do the project itself.

At least if I understood right and we want/need a permission, and regardless the fact this project could be a good way for Activision to sell even more copies of MW2, they could not be interested in this thing and consider the whole project bad for their business.

BUT. There's still no confirmation that he will ignore it, or that he will develop IW4M, so at this point, the conclusion that I come to is it won't be developed since he hasn't explicitly said he WILL continue with development.
